Help stop Chula Vista's new egregious Landlord Tenant Policy

Update 10-17-2022

In early October, the City of Chula Vista released a new version of the Tenant Protection Ordinance (TPO). The TPO was changed and reorganized. One major change is that unlike previous versions of the TPO and the State's AB 1482, newer properties are not excluded. Another change is the private right of action for tenants and unlimited attorney fees which can be used to vex an owner.


The city has delayed hearing this Ordinance several times before, but now must act as several Council Member's terms end in early December. We have been informed by the City that the Ordinance will be on the October 25 agenda for approval. Please reserve this date.

Please join with us, in person if at all possible, to testify against and defeat this Misguided Ordinance that strips away our property rights .


Update 7-15-2022


The City has now delayed consideration of the Tenant Protection Ordinance until August 9th. In the meantime The city has hired a consultant to conduct electronic surveys of both landlords and tenants before the next meeting.


Be advised there is a private company, possibly sympathetic to tenants, who is conducting this survey and monitoring the data. How will your info be safeguarded and used once they capture the information? Could it be used against you in the future? We suggest that you not respond to the survey request until we have further information



Update 7-2-2022

On May 17, this matter came back to the Chula Vista City Council. Staff made modifications and proposed an ordinance dated May 17, 2022. Councilwoman Andrea Cardenas was not present. Councilman John McCann was unable to vote on the measure due to the number of his rental properties.

Staff proposed two options:

Option A) Adopt the ordinance and have it take place in 30 days

Option B) Introduce and adopt the Ordinance on an emergency basis, having it take effect immediately - this option would require 4 out of 5 councilmember votes, and due to the absence an ineligibility was automatically non workable

After hours of testimony by both opponents and proponents, some of the remaining members had questions about the ordinance as drafted and the item was tabled until July.

City of Chula Vista to Bring Back Tenant Protection Proposals to the Housing Advisory Commission for a final review and recommendations. The (HAC) Committee members were torn. Staff brought a version of the Ordinance March 14, 2022. Only two of the five Committee Members voted to approve the revised Ordinance.. Three yes votes were needed, so the HAC just agreed to send the Ordinance back to the City Council


It is anticipated but not confirmed that the Ordinance will be on the City Council Agenda Tuesday, July 26 , 2022. Please save the date


There is a new Tenant Protection Ordinance (TPO) in the pipeline for APPROVAL IN Chula Vista. If approved, it will expand tenants rights above and beyond any existing state and federal laws.

Provisions include:

-Just cause EVICTION PROTECTION

-Requires 60 day notice to withdraw, remodel,or exit business

- Relocation payments of 2 MONTHS RENT at HUD RATE

-Expands the definitions of harassment and retaliation and the penalties

-Entitles tenants to return to previous units after they have been remodeled or removed from the market for up to 5 years

-Has language for CITY ENFORCEMENT and CRIMINAL PENALTIES

It was initiated by a referral by Mayor Mary Salas at a City Council meeting on Oct 26, 2021. The referral was to the city Housing Advisory Commission (HAC). The TPO issue is now being fast tracked and the HAC had a public hearing on it on Monday, January 31, 2022,


The ordinance was set up to go on to the City Council meeting on Feb 15th, however a small group of informed Chula Vista citizens and business owners raised issues at the HAC public hearing. The HAC members commented, conferred, and asked staff for additional information at the next meeting

The pro TPO side is being organized by Alliance of Californians for Community Empowerment or ACCE (formerly Acorn). ACCE was a coalition leader for Proposition W, the rent control issue in National City that was defeated in Nov 2018.

It has come to our attention that ACCE and proponents of the TPO will be speaking to and writing to the City Council this Tuesday (3-15-22). Please help to make sure that views opposed to this Ordinance are also expressed. Click here for the agenda


Concerned Chula Vista residents and property owners recognize that there is a shortage of housing in the city and request that:


1) The proposed Tenant Protection Ordinance be withdrawn because even the proposal of this Ordinance discourages new housing. Implementation and passage of such an Ordinance would certainly discourage new housing. This ordinance creates short term benefits for a select subset of residents and penalizes the whole city with impacted housing quality and quantity in the long run


2) The city recognizes that the cumulative effects of rules and regulation of government at all levels has INCREASED THE COST AND REDUCED THE SUPPLY OF HOUSING.


3) The city Prioritizes housing supply issues.


We do not yet know the next Chula Vista City Council or HAC activity relating to the TPO.
